On November 14, a federal court in New York ruled that the memo limiting DACA benefits and ending the acceptance of new applications had no legal authority because the issuing authority, Chad Wolf, was not serving as the acting secretary of Homeland Security.
On Wednesday, the court told both sides in the lawsuit to submit briefs on what the court should order the federal government to do to carry through its ruling. The briefing will end on December 1, at which point the court will issue a court order to the federal government regarding DACA.
The Law Offices of Lloyd E. Bennett Esq., P.C. will post a blog on or after December 1 that outlines the court’s orders regarding DACA. We’ll also outline how the order will affect both current DACA recipients and people who are eligible to apply.
