K-1 Fiancee Visa
This Visa permits the fiancée of a U.S. citizen to enter the U.S. for a 90-day period to marry the U.S. citizen and apply for conditional permanent residency. This visa must be applied for within the U.S. and it will thereafter be forwarded to the Consulate abroad who will contact the fiancee, forward additional forms and schedule an interview. Processing times vary from consulate to consulate and can range from 1-5 months. The visa must be used to enter the U.S. within four months from the date of issuance.

USCIS must be satisfied that:

  1. the parties met in person within two years of the date of filing the petition, a waiver is available if this results in extreme hardship to the petitioner or it violates strict cultural or social practices;
  2. have a bona fide intention to marry; and
  3. are legally able and actually willing to conclude a valid marriage in the U.S. within 90 days after the fiancée arrives.

If the parties do not marry within 90 days, the K-1 fiancée and any dependents will be required to depart or will be subject to removal.

DOCUMENTATION REQUIRED:

  • valid passport;
  • birth certificate;
  • divorce or death certificates from prior spouse;
  • police certificate of good conduct from residences since age 16, and where he/she has resided for six months or more;
  • medical examination;
  • proof of financial support in the U.S.;
  • proof of valid relationship (photos, e-mails, correspondence, receipts);
  • Photographs (Two photographs 1 and ½ inches square (37x37mm), showing full face, against a light background)
