Worker’s Compensation
An employee or their dependents can
receive workers' compensation
benefits for an injury or death arising out
of and in the
course of employment. The
employer or their insurance carrier pays for
necessary and reasonable
medical treatment, loss of
wages during the period of rehabilitation and
when documented,
benefits for permanent disability.
What must a worker do if injured
on the job?
The worker should notify
his/her employer as soon
as possible. The notice may
be given to the foreman,
supervisor, personnel office,
or anyone in authority at the employer's
place of business. Notice
does not have to be in writing.
If the worker is in need
of medical treatment,
a request should be made to the employer
as soon as possible.
Under the NJ workers' compensation
law, the employer and/or
their insurance carrier can select the physician(s)
to treat injured
workers
for work related injuries.
If the worker
is not treated at
the authorized treatment center the worker
may have to pay the bill.
In the event the employer refuses to authorize
medical care the worker may choose to file a "Motion
for Medical and Temporary Benefits" which
is assigned an initial hearing date before a
Judge of Compensation within 30 days of filing.
If the parties are unable to resolve issues in
dispute during pre-trial conferences, trial commences
and a judge issues a decision based upon the
relevant evidence surrounding the case.
Please note that there is a two year
Statute of Limitations period that applies to
workers' compensation cases. To obtain an award
for injuries, a formal claim must be filed within
two years from either the date of injury or the
last payment and/or authorized medical treatment.
Claims filed subsequent to this two year time
period may be subject to dismissal.

Automobile Accidents

and advise them of the accident. Obtain a Police
Report and
send it to them, take pictures

New Jersey is a no-fault insurance
state. This means that in most cases
the medical bills will be
paid by your automobile insurance
company even if your vehicle was
not involved in the accident.
If you have no automobile insurance
then it will be paid by the insurance
company of the vehicle you
were in. Payment is made under
the "PIP Coverage" of the policy. "PIP" is
short for Personal Injury Protection. Pre-certification
of the treatment by the insurance carrier is
often required before treatment can begin.
