What is a V-Visa?
If your spouse is a legal permanent resident in the United States and you have applied for an immigrant visa but have been waiting for its approval for 3 or more years, you may be granted a V-Visa, a temporary visa specifically for spouses and minor children. You may also be granted work authorization with this visa. To qualify for this type of visa your lawfully immigrated spouse must have filed an immigrant visa petition for you on or before 12-21-2000 or you have been waiting three years since the filing of your petition, and your interview has not been scheduled for you as of yet.
Individuals in the U.S. with another visa status may apply for a change to the V status. Individuals outside of the U.S. may apply for a V visa and present proof of eligibility at the appropriate U.S. consulate. The required proof of eligibility includes evidence of a pending or approved I-130 immigration visa petition. After a visa number becomes available, V-Visa holders who are in the U.S. may apply for adjustment of status in order to become permanent residents.
