Does a NAFTA visa apply to you?

Nowhere does this apply more than in helping individuals to obtain a NAFTA TN visa.

NAFTA stands for the North American Free Trade Agreement which was entered into by the United States, Canada and Mexico and created special economic and trade relationships for those countries. The nonimmigrant NAFTA Professional (TN) visa allows citizens of Canada and Mexico, as NAFTA professionals, to work in the United States. To be eligible, the U.S. employment must be in a profession listed in the NAFTA agreement and the employee must have the required credentials. Permanent residents, including Canadian permanent residents, are not able to apply to work as a NAFTA professional, nor are self-employed professionals. A foreign national from Mexico or Canada can apply for this visa for an initial one year stay with unlimited one year extensions.

New Jersey Immigration Lawyer

The NAFTA TN visa allows professionals of Canada or Mexico to work in the U.S. under the following conditions:

  • Applicant is a citizen of Canada or Mexico
  • Profession is on the NAFTA list
  • Position in the U.S. requires a NAFTA professional
  • Mexican or Canadian applicant is to work in a prearranged full-time or part-time job for a U.S. employer (Self-employment is not permitted)
  • Professional Canadian or Mexican citizen has the qualifications of the profession.
