Applying for a Nurse Visa

Nurses applying for visas can apply for various types of visas that will work for their profession.  They can apply for temporary non-immigrant status or for permanent status.  Recent changes in immigration law have made the process easier for registered nurses to get a visa, although there are still limitations on the number of foreign national nurses that can apply.

Registered nurses (RNs) are treated in very special ways by U.S. immigration laws. Some requirements highly favor foreign nurses; however, others impose additional documentation and examination requirements on RNs.  To ensure you are seeking the correct visa for your immigration needs, it is best to consult with a qualified New Jersey Immigration Lawyer from the Law Offices of Lloyd E. Types of Nurse Visas

A registered nurse may apply for either a temporary non-immigrant visa or an immigrant visa. Your immigration attorney can best help you to make a decision as to which one would be better for your circumstances.

Non-Immigrant Visa for RNs can apply for the following types of visas:

H-1C
Only hospitals in underserved areas that have received attestation from the Department of Labor are able to file for this type of visa. There are currently less than 15 hospitals in the United States that have received this approval. In addition, there are only 500 visas available.

TN
TN visas are available for professionals from of Mexico and Canada. RNs qualify for TN visas. Canadians require an offer of employment from a U.S. employer for a period not to exceed one year, a license in Canada and in the state of intended employment, proof of Canadian citizenship, and a small fee to enter the United States. Mexicans require a more complex labor certification.

H-1B
This visa is reserved for foreign workers in a specialty occupation. The H1-B requires a bachelor's degree. Most nursing jobs in the United States do not. There are many requirements to qualify for this type of visa, which are outlined in the following USCIS memo and it also lists various nursing occupations that may qualify.

Immigrant Visas for RNs

A registered nurse may apply for an immigrant visa, however they are difficult to obtain.  Extensive requirements are outlined by the USCIS which our law firm is well versed in. While these visas require a great deal of work on behalf of the applicant, they are available without the requirement of a labor certification (except for Mexicans under TN). Our firm is capable of steering the applicant thought the application process and addressing any issues that may develop during the processing of the visa.  Due to the severe shortage of RNs in the United States, we expect to see reforms from Congress to help alleviate the shortage.
