When an international company has an employee who has been posted abroad in an executive, managerial or specialized knowledge capacity for at least one continuous year and is being temporarily transferred to the United States to work in a similar capacity, the employee may apply for an L-1 Intra Company Transfer visa.  The company must be the parent company, a branch, subsidiary or affiliate of the same organization.  The USCIS requires evidence of the qualifying relationship including proof of employment abroad with the same company, detailed description of job duties and qualifications.  If approved, the spouse and children under 21 will be allowed to accompany the L-1 visa holder while he is posted in the U.S.
