New Jersey / New York Immigration Visa Attorney

H-1B Specialty Occupation Visa or "Work Permit"

Another non-immigrant visa for working in the United States is the H-1B Specialty Occupation Visa.  This Visa allows a foreign individual to enter America for the purposes of employment for up to six years.  This form of visa is faster to apply for than a US Green Card and is the most common visa used by most employers to hire foreign nationals on a temporary basis.  There are technical points and considerable documentation that must be carefully prepared for your application to quickly and efficiently go thru the complex federal immigration system.  A well trained New Jersey immigration attorney can assist you in this process.

The individual from a foreign company may not apply for an H-1B visa.  An employer must petition for entry of the employee into the states.  Employers in the United States may begin the application process six months before the actual start date of the visa. 

The H1B visa, also known as a "Work Permit", is designed to be used for staff in "specialty occupations".  That would include those occupations which require a high degree of specialized knowledge.  Generally speaking, the job position would be relevant to a 4-year US Bachelor's degree requirement.   This requirement can also usually be met by having a 3-year degree and 3 years' relevant post-graduate experience.  For non-graduates, they may be employed on an H1B specialty occupation visa where they can claim to be 'graduate equivalent' by way of twelve or more years' experience in the occupation.  For positions that are not "specialty occupations", or for which the person lacks the qualifications or experience, can use an H-2B visa.
