Green Cards Petitioned Through Employment

If you are a foreign national and wish to stay in the United States permanently, you need to have a Green Card which has been petitioned through employment.  An immigrant of the U.S. is a foreign national who has been authorized by the U.S. Government to live and work permanently in the United States.

This immigration procedure involves multiple steps, which include:

  1. It needs to be determined that the foreign national and employer are eligible for lawful permanent residency under one of the U.S. Citizenship and Immigration Services (USCIS) paths.
  2. The U.S. employer must complete a labor certification request (Form ETA 750) for the applicant, and submit it to the Department of Labor's (DOL) Employment and Training Administration.
  3. The USCIS must receive and approve an immigrant visa petition, Form I-140. This is a Petition for Alien Worker. The employer files this petition.  The employer acts as the sponsor (or petitioner) for the applicant (or beneficiary).  However, if a Department of Labor certification is needed the application can only be filed after the certification is granted.
  4. The State Department must issue an immigrant visa number to the applicant, even if the applicant is already in the United States.
  5. If the applicant is outside the United States when an immigrant visa number becomes available, he or she will be notified and must complete the process at his or her local U.S. consulate office.  If the applicant is already in the United States, he or she must apply to adjust to permanent resident status after a visa number become available.
