On 3/17/16 I attended a quarterly meeting at USCIS. At the meeting I had
a chance to hear form the Newark Field Office Director Ms Randi Borgen
and her staff about local issues concerning immigration lawyers and their
clients. We discussed new hardship guidelines regarding 601(a) waivers
that are expected to be released by USCIS shortly along with Parole in
Place for family members or current and former members of the military.
There has been a lot of confusion lately as to what happens when there
is an old deportation order. The confusion was clarified and the proper
procedure to deal with this cases was discussed.
We learned that Naturalization filings are up 50% over last year and that
has lead to a delay in processing of slightly over five (5) months. I-485's
are also experiencing delays and are currently taking about ten (10) months.
The Director said she was hoping to bring those times down in line with
the national averages.
At the conclusion of the meeting we discussed other important issues such
as notario issues, wait times at interviews, denials of cases involving
"old" labor certification filings as proof of 245i compliance,
physical presence issues for principals in 245i cases and consulate document
requests. We also had an opportunity to say thank you and goodbye to the
Field Office Director in Mt. Laurel Ms. Nieves Cardinale who is transferring
to another Field Office. We will miss her and wish her well.
As always we thank the Field Office Director and her staff for her willingness
to constantly meet and discuss issues of local concern.
